Greg Beck and Andrea Ziarko successfully defended a public sector employer in an FMLA interference/ discrimination/ retaliation case that proceeded to jury trial in federal court before Judge Adams the week of February 11, 2019. The case was complex and involved an employer’s decision to terminate an employee for abuse of the township’s sick leave policy. The plaintiff claimed the termination violated his federal rights under the Family Medical Leave Act which he applied for during the time of his absence. The plaintiff also claimed the termination was retaliatory based on his application for FMLA and the township failed to accommodate his disability as requested through his FMLA application.
